The Essential Guide to Employing Foreign PMEs in Singapore

Employment law in Singapore can sometimes be tough for companies, particularly those which rely on foreign manpower at higher levels in the organisation. Employment Passes have been harder to come by and the approval process is opaque. This can impact companies who rely on individuals with specific skill-sets from overseas. Some companies have tried to cheat the system by being less than truthful in their applications and have paid a heavy price.

Our guest speaker, Mr Samuel Sharpe, Director, Duane Morris & Selvam LLP, will provide an overview of some of the key legal and policy issues as well as potential pitfalls that all companies should be aware of when employing “foreign talent”. Topics to be covered will include:

• the employment pass application and appeals process (and the Ministry of Manpower’s (MOM) criteria and underlying policies on this);
• the penalties for misleading MOM in applications (including what to do if you are investigated by the MOM); and 
• employment rights in Singapore, including changes put forward in the ongoing public consultation into amendments to the Employment Act.
